Student Wins Refund in Battle Against Private Teaching Company for Health-Related Reasons

In a significant decision, a court has ruled in favor of a student who was ordered to refund for a training course at EAE Business School due to an aggravation of Crohn’s disease. This ruling highlights the challenges faced by chronically ill individuals when resolving contracts due to unexpected health complications.

Initially, the private teaching company defended their decision not to refund the student, arguing that the disease was pre-existing and there were no health reasons preventing him from taking the course. However, the court ruled against them, citing the unforeseen deterioration of the student’s health that made it impossible for him to continue with the training.

The final ruling in favor of the student requires EAE Business School to return the amounts paid for the course. The court criticized the lack of medical documentation provided by the company to support their argument that the student could have taken the course despite his illness.
