Tower Health Defends Against Health Information Sharing Lawsuit: Judge Dismisses Case with No Amendment

In Pennsylvania, a healthcare provider known as Tower Health emerged victorious in defending against a proposed class action lawsuit. The lawsuit, brought by plaintiffs Patrick Santoro and Jessica Landis, accused Tower Health of sharing patients’ personal health information with Meta Platforms Inc., violating the Electronic Communications Privacy Act and common law. However, Judge John F. Murphy of the US District Court for the Eastern District of Pennsylvania ruled that Santoro and Landis failed to demonstrate that the disclosed information was sensitive health data, which was detrimental to their claims of negligence, intrusion upon seclusion, and violations of the ECPA. As a result, he dismissed the lawsuit without giving them an opportunity to amend their complaint.

In this case, Santoro and Landis alleged that Tower Health had improperly shared their health information with Meta Platforms Inc., leading to legal action. However, their inability to prove that the disclosed information was sensitive health data ultimately led to the case being dismissed by Judge Murphy. Despite these allegations, Tower Health successfully defended itself against them.
