Mother awarded $1.5 million in case against Zumbro Valley Health Center following son’s death

In a lawsuit against Zumbro Valley Health Center, a Red Wing mother was awarded $1.5 million by jurors after the death of her son in 2021. The court records revealed that Jill Adams received the settlement due to the negligence of the Rochester health center in its care and treatment of Caleb Malek, who was 23 at the time of his passing.

According to court records, Malek tested positive for fentanyl, Percocet, and THC while in a sober living home and subsequently went to Zumbro Valley Health Center for detox. The lawsuit alleged that employees did not adhere to the policy of checking on Malek every 15 minutes, nor did they properly screen him for drugs upon admission. It was also claimed that Zumbro Valley failed to adequately train staff on how to recognize signs of a breathing problem.
