Manatt Unveils Health Artificial Intelligence Policy Tracker

A new tool by Manatt, Health AI Policy Tracker, is now available to help identify the most important federal and state policy activity related to AI in the health care industry. The tracker covers both federal legislative and regulatory activity up until the present date, as well as state legislative activity introduced between January 1st and March 31st, 2024. Updates to the tracker will be made quarterly, with the next one scheduled for Q2 (June 2024).

The legal and regulatory landscape surrounding AI in health care is constantly evolving as policymakers at both the federal and state levels work to establish regulations that balance its potential for transformation with concerns about safety, security, privacy, accuracy, and bias. Although there currently is no specific federal law governing AI, several government agencies including the White House are in the process of proposing regulations that will oversee its use. Entities such as ONC, CMS, OCR, FDA, DOJ and FTC are all working on proposed laws and regulations related to AI. This level of activity is expected to increase in the second half of 2024 due to deadlines set by President Biden’s Executive Order on responsible AI.
